The United States District Court for the District of Delaware established the guidelines for the CITGO auction through an oral order issued by Judge Leonard P. Stark.
The magistrate, after determining that the participating entities had sufficient time but only planned to remain in court for one more day in this phase of the process, decided to focus the next session on specific activities.
In this regard, he agreed that completing the scheduled presentation of evidence for this week would be the most useful, listening to brief summaries of significant disputes noted by the entities, as well as raising and discussing questions that would help refine the future informational session following the hearing.
CITGO Auction Activities
The order issued by Judge Stark on September 17, 2025, states that the CITGO auction activities for September 18 are as follows:
- The three designated witnesses will be able to testify, with examinations not significantly exceeding the estimates provided by the lawyers.
- The court will have a brief discussion with the interested parties regarding the pending request from the judicial expert to finalize the SPA for Dalinar, sign the SPA for Amber Energy, and address objections to said request.
- Final comments will be heard in the order established in the status report dated September 9. Each arguing entity will have approximately five minutes to present their case uninterrupted, followed by a possible round of questions from the court.
- Additionally, each party involved in the process, including Crystallex, ConocoPhillips, the Venezuelan entities, Amber Energy, and Gold Reserve, will be allowed a rebuttal of up to five minutes, during which the court may pose new questions.
